LA CUSCRII SRL.<\/strong> Using the site or making a reservation implies full acceptance of these Terms and Conditions.<\/p><h2 class=\"tc-h2\">1. Definitions<\/h2><ul class=\"tc-ul\"><li><strong>\u201e&quot;The Provider&quot;\u201d<\/strong> \u2014 PENSIUNEA LA CUSCRII SRL, CUI 40849472, with headquarters at Calea Bodrogului no. 20, Arad<\/li><li><strong>\u201e&quot;The Client&quot;\u201d<\/strong> \u2014 any natural or legal person who uses the site, requests an offer or benefits from the Provider&#039;s services<\/li><li><strong>\u201e&quot;The website&quot;\u201d<\/strong> \u2014 the domain pensiune-arad.ro and all associated subdomains<\/li><li><strong>\u201e&quot;Reservation&quot;\u201d<\/strong> \u2014 the Client&#039;s firm commitment to benefit from a service on a set date, confirmed by the Provider<\/li><li><strong>\u201e&quot;Services&quot;\u201d<\/strong> \u2014 accommodation, restaurant, event organization, leisure activities and any other services offered by the Provider<\/li><\/ul><h2 class=\"tc-h2\">2. Accommodation Reservations<\/h2><h3 class=\"tc-h3\">2.1 Booking Confirmation<\/h3><p class=\"tc-p\">The reservation is considered confirmed when the Client receives a written (email) or verbal (telephone) confirmation from the Provider. Without this confirmation, the place is not guaranteed.<\/p><h3 class=\"tc-h3\">2.2 Advance and Payment<\/h3><p class=\"tc-p\">The provider may request an advance payment to guarantee the reservation, according to the conditions communicated at the time of confirmation. The remaining balance is paid upon check-in or as previously agreed.<\/p><h3 class=\"tc-h3\">2.3 Check-in \/ Check-out<\/h3><ul class=\"tc-ul\"><li><strong>Check-in:<\/strong> from 2:00 p.m.<\/li><li><strong>Check out:<\/strong> until 12:00<\/li><li>Early check-in or late check-out are possible subject to availability and may be subject to an additional fee, determined on site.<\/li><\/ul><h3 class=\"tc-h3\">2.4 Cancellation Policy \u2014 Accommodation<\/h3><div class=\"tc-info\"><p class=\"tc-p\"><strong>Cancellation at least 48 hours before arrival date:<\/strong> Free, no penalties.<br><strong>Cancellation in less than 48 hours or no-show:<\/strong> The value of the first night&#039;s accommodation or the advance payment paid, whichever is lower, will be retained.<\/p><\/div><p class=\"tc-p\">Cancellation must be communicated in writing to <a href=\"mailto:rezervari@pensiune-arad.ro\" class=\"tc-link\">rezervari@pensiune-arad.ro<\/a> or by phone at <a href=\"tel:+40771449599\" class=\"tc-link\">0771 449 599<\/a>.<\/p><h2 class=\"tc-h2\">3. Private Event Reservations<\/h2><h3 class=\"tc-h3\">3.1 Confirmation Advance<\/h3><p class=\"tc-p\">The organization of a private event (baptism, wedding, conference, anniversary, party, etc.) is confirmed by a minimum advance payment. <strong>30% of the estimated value<\/strong> of the event. The date is blocked exclusively for the Client&#039;s event after the advance payment and signing of the collaboration agreement.<\/p><h3 class=\"tc-h3\">3.2 Date Modification<\/h3><p class=\"tc-p\">Changing the date of an event is possible with a minimum <strong>30 calendar days<\/strong> before the original date, once only and at no additional cost, subject to availability. Rescheduling less than 30 days may be subject to additional costs.<\/p><h3 class=\"tc-h3\">3.3 Cancellation Policy \u2014 Events<\/h3><div class=\"tc-info\"><p class=\"tc-p\"><strong>Cancellation more than 60 days in advance:<\/strong> The advance is refunded 50%.<br><strong>Cancellation between 30 and 60 days before:<\/strong> The advance payment is not refundable, but can be used for rescheduling.<br><strong>Cancellation less than 30 days in advance:<\/strong> The advance payment is not refundable; the Provider may also request additional damages if the expenses incurred exceed the amount of the advance payment.<\/p><\/div><h3 class=\"tc-h3\">3.4 Final Number of Guests<\/h3><p class=\"tc-p\">The client is obliged to communicate the final number of guests with a minimum <strong>7 calendar days<\/strong> before the event date. Billing is based on the confirmed number of people, even if the actual attendance is lower.<\/p><h2 class=\"tc-h2\">4. Prices and Payment Methods<\/h2><h3 class=\"tc-h3\">4.1 Prices<\/h3><p class=\"tc-p\">All prices displayed on the site are expressed in <strong>Romanian lei (RON) and include VAT<\/strong>, unless otherwise specified. Prices are indicative and subject to change without prior notice. Already confirmed and advanced reservations are not affected by price changes.<\/p><h3 class=\"tc-h3\">4.2 Accepted Payment Methods<\/h3><ul class=\"tc-ul\"><li><strong>Online bank card<\/strong> \u2014 through the secure payment processor integrated on the site (PCI-DSS certified)<\/li><li><strong>Cash<\/strong> \u2014 at the guesthouse reception<\/li><li><strong>Bank transfer<\/strong> \u2014 based on the proforma invoice, according to the data communicated by the Provider<\/li><\/ul><div class=\"tc-warn\"><p class=\"tc-p\">\u26a0 Your bank card details are processed exclusively by the payment processor. The provider does not store, view or have access to your bank details.<\/p><\/div><h2 class=\"tc-h2\">5. Customer Obligations<\/h2><p class=\"tc-p\">By using the Provider&#039;s services, the Client undertakes to:<\/p><ul class=\"tc-ul\"><li>To respect the internal rules of the guesthouse, available at the reception and on the website<\/li><li>To use the hostel&#039;s spaces and facilities with care, avoiding damaging them<\/li><li>Do not disturb the peace of other guests or the neighborhood (quiet schedule: 10:00 PM\u20138:00 AM)<\/li><li>Smoking is only allowed in designated areas; smoking in rooms is prohibited and may incur a cleaning fee.<\/li><li>To announce the presence of pets in advance; they are allowed with the prior consent of the Provider and with the payment of an additional cleaning fee<\/li><li>To comply with legal regulations regarding activities carried out on the guesthouse property<\/li><\/ul><h2 class=\"tc-h2\">6. Obligations of the Provider<\/h2><p class=\"tc-p\">The provider undertakes:<\/p><ul class=\"tc-ul\"><li>To provide the reserved services to the Client, under the agreed conditions and quality.<\/li><li>To ensure accommodation in the reserved room or, in case of objective impossibility, in an equivalent or superior one, with the Client&#039;s consent.<\/li><li>Maintain standards of cleanliness and functionality of the spaces<\/li><li>To respond to Customer requests within a reasonable time<\/li><\/ul><h2 class=\"tc-h2\">7. Liability and Limitations<\/h2><h3 class=\"tc-h3\">7.1 Valuables<\/h3><p class=\"tc-p\">The provider does not assume responsibility for <strong>money, jewelry, documents or other valuables<\/strong> left unattended in rooms or common areas. Customers are advised to use the in-room safe or deposit valuables at reception.<\/p><h3 class=\"tc-h3\">7.2 Customer-Produced Damage<\/h3><p class=\"tc-p\">The Client is responsible for any damage to the property of the guesthouse caused by him or by persons in his care (including minors or guests at the event). The cost of repair or replacement will be charged to the Client.<\/p><h3 class=\"tc-h3\">7.3 Motor vehicles<\/h3><p class=\"tc-p\">Private parking is provided free of charge. The provider is not responsible for theft from or damage to vehicles in the parking lot.<\/p><h2 class=\"tc-h2\">8. Force Majeure<\/h2><p class=\"tc-p\">Neither Party shall be held liable for failure to fulfill contractual obligations caused by a force majeure event, as defined by the Romanian Civil Code (art. 1.351), including natural disasters, epidemics, legal restrictions imposed by authorities, general strikes or other unforeseeable and unavoidable events.<\/p><p class=\"tc-p\">In case of force majeure, the affected Party shall notify the other Party in writing within 48 hours of the occurrence of the event. Advance payments will be fully refunded in cases of proven force majeure.<\/p><h2 class=\"tc-h2\">9. Intellectual Property<\/h2><p class=\"tc-p\">All contents of the pensiune-arad.ro website \u2014 texts, images, photographs, logos, graphics \u2014 are the property of PENSIUNEA LA CUSCRII SRL or are used with the consent of the rights holders. Reproduction, distribution or use thereof without the written consent of the Provider is prohibited and is punishable under Law no. 8\/1996 on copyright.<\/p><h2 class=\"tc-h2\">10. Personal Data Protection<\/h2><p class=\"tc-p\">The Provider processes the personal data of the Clients in accordance with EU Regulation 2016\/679 (GDPR) and Law no. 190\/2018. Full details on the types of data collected, the purpose of processing and your rights are available in <a href=\"\/en\/politica-de-confidentialitate\/\" class=\"tc-link\">Privacy policy<\/a>.<\/p><h2 class=\"tc-h2\">11. Dispute Resolution<\/h2><h3 class=\"tc-h3\">11.1 Amicable Settlement<\/h3><p class=\"tc-p\">Any misunderstanding or complaint will be resolved amicably in the first instance. We are committed to responding as quickly as possible. <strong>10 working days<\/strong>.<\/p><h3 class=\"tc-h3\">11.2 ANPC and ADR<\/h3><p class=\"tc-p\">If the dispute cannot be resolved amicably, the Consumer Client has the right to appeal to:<\/p><div class=\"tc-info\"><p class=\"tc-p\"><strong>National Authority for Consumer Protection (ANPC)<\/strong><br>Website: <a href=\"https:\/\/www.anpc.ro\" class=\"tc-link\" target=\"_blank\" rel=\"noopener\">www.anpc.ro<\/a> \u00b7 Phone: 021 9551<br><br><strong>European Online Dispute Resolution (ODR) platform:<\/strong><br><a href=\"https:\/\/ec.europa.eu\/consumers\/odr\" class=\"tc-link\" target=\"_blank\" rel=\"noopener\">ec.europa.eu\/consumers\/odr<\/a><\/p><\/div><h3 class=\"tc-h3\">11.3 Competent Court<\/h3><p class=\"tc-p\">If amicable settlement or through ADR is not possible, disputes will be resolved by the competent courts at the Provider&#039;s headquarters \u2014 <strong>Arad Court<\/strong>, according to Romanian law.<\/p><h2 class=\"tc-h2\">12. Applicable Law<\/h2><p class=\"tc-p\">These Terms and Conditions are governed by <strong>Romanian law<\/strong>. The contract between the Provider and the Client is subject to the Romanian Civil Code, GEO no. 34\/2014 on distance contracts (in the case of online reservations), Law no. 363\/2007 on combating unfair practices, OG no. 58\/1998 on the organization and conduct of tourism activity.<\/p><h2 class=\"tc-h2\">13. Changes to the Terms and Conditions<\/h2><p class=\"tc-p\">The Provider reserves the right to modify these Terms and Conditions at any time, without prior notice. The modifications shall enter into force on the date of publication on the site.
